McCracken Tent Rental
Rental Contract Terms and Conditions

RESERVING EQUIPMENT & CANCELLATIONS:
- Tents and accessories will be reserved ONLY upon receipt of a signed rental contract and a 50% NON-REFUNDABLE deposit (cash, personal check and/or bank check).
- All reserved equipment/rentals cancelled less than ten days from event will be charged full rental price.
- Final changes to the rental agreement are due ten days before your event. Changes made with less than ten days to the event are subject to a late fee.
SITE PREPARATION:
- Please be sure your site is ready (i.e. lawns mowed, vehicles out of the way, etc.) before crew arrives. Client is responsible for reaching out prior to delivery if there are concerns about the condition of the site, i.e. wet ground, mud conditions, etc.
- Our tents are pole d and require staking into the ground. It is your responsibility to inform McCracken Tent Rental if the set up is not on grass. If the surface is something other than grass, McCracken Tent Rental will determine if tent can be set up and what the additional fee for set up will be.
- Client assumes responsibility for determining if building and/or fire permits are required with the State of Vermont and filing for said permits if necessary.
- Client assumes responsiblity for contacting DIGSAFE (8-1-1) to ensure their site is ready. Call DIGSAFE at least 2 weeks prior to event. Client is responsible for informing McCracken Tent Rental of the existence of any underground utilities (i.e. phone or gas lines, septic system, etc.), or conditions that may interfere with the ability to stake and/or anchor equipment. Client assumes all responsibility for all damage to underground equipment in absence of such notice.
DELIVERY/PICKUP SERVICE SPECIFICS

Delivery service is available on most orders, however is dependent upon geographic location as well as availability.

Tables and chair only deliveries are not guaranteed during peak season (June 1 through Sept 30) and will be subject to a surcharge during peak sesason.

All delivery/travel fees are based on geographic location.

All items will be delivered and picked up at the same designated location
- The client should be available to count all items upon delivery and pickup, otherwise, the counts will be considered accurate.
- Please note delivery schedule is finalized the week before your event. Delivery typically occurs the day before your event (for larger tent rentals delivery will occur 1-3 days in advance of your event) and take down occurs the day after your event (beginning as early as 9 am).
- Tent rentals are for one day however you can extend the reservation if needed
- Responsibility for equipment remains with the client from the time of delivery to the time of pickup.
- Please be sure all equipment is secured when not in use and protected from the weather.
- All floral arrangements, trash, and decorations of any kind should be removed from tent before scheduled pickup time.
- All chairs and tables should be stacked and folded as delivered.
FINAL PAYMENT REQUIREMENTS:
Client must provide McCracken Tent Rental with a completed order 10 days prior to event (or be subject to a late fee) at which time an updated invoice with balance due will be emailed/mailed or delivered with order. Final payment/balance is due one week prior to your event.
DECORATIONS
Decorations are permitted under the tent, however the use of streamers is not permitted as they can stain the tent and/or poles if they become damp/wet.
WEATHER CONDITIONS:
Client understands that tents are temporary structures designed to provide limited protection from weather conditions, such as sun and rain; however there may be circumstances involving strong winds and lightning, in which the tents will not provide adequate protection and may even be blown over or damaged. Evacuation of tents to avoid possible injury is recommended when severe weather threatens the area where the tent is erected. People should not seek shelter in tents during such conditions. McCracken Tent Rental accepts no responsibility and recommend clients be aware of changing weather conditions and to exercise best judgment with regard to the evacuation of the tents. Client agrees that in the event of a predicted or actual storm or excessive winds, McCracken Tent Rental may dismantle any equipment that has been previously installed to ensure safety of all involved.
DEFENSE:
Client agrees that if legal proceedings for compensation for personal injuries or property damage arising out of the event are brought against McCracken Tent Rental, client will indemnify McCracken Tent Rental and its employees against any judgments which may be rendered against them except for judgments on claims which arise out of the negligence, gross negligence or willfull acts or omissions of McCracken Tent Rental, its agents, servants or employees.
ADDITIONAL CHARGES/FEES TO BE AWARE OF:
- Client changes contract less than ten days prior to their event
- Required permits (building and/or fire) with State of Vermont including special equipment, such as fire extinguisher and/or exit signs
- The site preparation is not followed and site is not ready or accessible* when the crew arrives. *Site must be accessible via vehicle to unload items
- The tent and rented equipment is not ready for prearranged pickup(d)
- Delivery or pickup is from any location involving upstairs or downstairs
- Any rental equipment and accessories are damaged
All equipment and/or accessories are to be returned according to these TERMS AND CONDITIONS. The client is responsible for any additional charges incurred as a result of failure to meet these conditions. All attorney fees, collection fees, any expense involved in the collection of rental charges, or court costs will be client’s responsibility.
